1. General & Application

1.1. These Terms and Conditions (“Terms”) apply to all quotes, sales, custom manufacturing, supply, and installation services provided by Australian Lift Protection (“ALP”, “we”, “us”, or “our”) to the customer (“Customer” or “you”).

1.2. These Terms apply across ALP’s full range of products and services, including but not limited to custom lift protection blankets, site timber protection cladding, lift mirror and glass replacement, architectural interior vinyl wraps, studs/hooks hardware, and associated on-site installation, survey, and removal services.

1.3. By accepting a quotation, paying an invoice, submitting a Lift Blanket Customer Measure Form, issuing a purchase order, or approving custom drawings, you agree to be bound by these Terms.

2. Quotations, Pricing & Payment

2.1. Quotations remain valid for 30 days from the date of issue unless otherwise specified in writing.

2.2. All prices quoted are in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless explicitly stated.

2.3. Payment Terms: Full payment of the invoice (or agreed deposit for commercial accounts) is required prior to the commencement of shop drawings, custom manufacturing, material procurement, or dispatch.

2.4. Orders will not enter the production schedule until full payment is received in cleared funds and custom drawings or scope details are approved.

3. Measurements, Specifications & Drawing Approval

3.1. Customer Measurements: Customer-supplied measurements via our Lift Blanket Customer Measure Form or site plans constitute the sole basis for manufacturing. The Customer is entirely responsible for the accuracy of all dimensions, cutout locations, button positions, floor positions, and lift details submitted.

3.2. ALP Site Surveys: Where ALP is engaged to conduct site measurements or surveys (e.g. for glass, vinyl wraps, or timber cladding), the Customer must ensure unrestricted access to the lift car during the agreed survey window.

3.3. Drawing Sign-Off: ALP will provide custom drawings based on the details submitted. Manufacturing will only commence once written drawing approval is received from the Customer.

3.4. Corrections & Revisions: Once drawings are approved, any subsequent alterations requested by the Customer may incur additional charges and may alter production timelines.

3.5. Error Liability: ALP accepts no liability or responsibility for blankets, timber, glass, or wraps manufactured incorrectly due to inaccurate measurements, incomplete details, or erroneous sign-offs provided by the Customer.

4. Custom Manufacturing & Production Lead Times

4.1. Custom Goods: All Lift Protection Blankets, timber cladding panels, safety glass, and vinyl wraps are custom made-to-order products tailored to specific lift dimensions.

4.2. Lead Times: Our standard manufacturing lead time is 7–10 business days (unless a different timeline is specified in writing for specialised works).

4.3. Commencement of Lead Time: Lead times commence strictly after both (a) full invoice payment is received, and (b) written approval of manufacturing drawings or scope is provided by the Customer.

4.4. Delays: ALP will make every reasonable effort to meet quoted delivery dates but shall not be held liable for delays caused by force majeure, material supply shortages, courier issues, or delayed client approvals.

5. Delivery & On-Site Worksite Requirements

5.1. Delivery: Delivery is made to the single address specified in the quote and email correspondence. Delivery is deemed complete upon drop-off at the ground floor/loading dock unless otherwise agreed in writing.

5.2. Site Access: Where stud installation, timber cladding, mirror replacement, vinyl wrapping, or site delivery is included:

  • The Customer must ensure safe, clear, and unobstructed access to the lift car and work area during agreed times.

  • If required, the lift must be isolated, parked, and made safely available exclusively for our installation team.

  • The Customer is responsible for securing any necessary site inductions, parking permits, lift booking slots, and building manager approvals prior to our team's arrival.

5.3. Substrate Condition (Glass & Vinyl Wraps): For mirror replacement or vinyl wrap application, existing lift car surfaces must be clean, dry, structurally sound, and free from rust, oil, or severe moisture damage prior to installation.

5.4. Abortive Site Visits: If our installation team attends the site and cannot perform work due to lack of access, site safety hazards, unbooked lifts, unready substrates, or incomplete site preparation, a re-attendance visit fee will apply.

6. Timber Protection Cladding Terms

Where timber lift protection cladding (plywood protection for lift walls, door frames, handrails, or floors) is supplied and installed:

6.1. Timber protection cladding is designed as a temporary protective barrier during construction, fitout, or removal works.

6.2. Ownership, Removal & Disposal: Upon supply and installation, all timber protection materials become the property of the Customer. The Customer is responsible for the ongoing maintenance, removal, and disposal of the timber cladding upon completion of their project. At the Customer’s request, ALP may, at its sole discretion, agree to assist with the removal or collect and reclaim select reusable timber materials from the site.

6.3. Site Protection & Alterations: The Customer must ensure site personnel, trades, or contractors do not alter, modify, or vandalise timber panels during the protection period.

6.4. Scheduling Removal Services: Any requests for ALP to assist with timber removal or collect reusable materials must be scheduled in advance and may be subject to additional service fees.

7. Cancellation & Returns

7.1. Non-Cancellable Orders: Because all products (blankets, timber, glass, vinyl wraps) are custom manufactured to bespoke specifications, orders cannot be cancelled, returned, or refunded once drawing approval has been given and production or material cutting has commenced.

7.2. Pre-Production Cancellations: If an order is cancelled prior to drawing approval, ALP reserves the right to charge an administration, drawing fee and material costs to cover work performed to date.

8. Warranty & Defects

8.1. Manufacturer’s Warranty: ALP warrants that custom Lift Protection Blankets and supplied goods will be free from defects in materials and workmanship for a period of 12 months from the date of supply or installation.

8.2. Exclusions: This warranty does not cover:

  • Fair wear and tear resulting from standard site use, heavy construction impacts, sharp trade tools, or harsh chemical exposure.

  • Misuse, improper installation (where not installed by ALP), improper storage, or modification by third parties.

  • Incorrect sizing arising from customer-supplied measurement errors.

8.3. Defect Claims: Any claim for defective workmanship, incorrect dimensions (not matching approved drawings), or missing components must be reported in writing within 7 days of delivery or installation, including photographic evidence.

8.4. Australian Consumer Law: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied by the Competition and Consumer Act 2010 (Cth).

9. Limitation of Liability

9.1. To the maximum extent permitted by law, ALP’s liability for any breach of these Terms or statutory guarantees is limited, at our option, to:

  • Re-supplying or repairing the affected goods; or

  • Refunding the cost of the affected goods or services.

9.2. Under no circumstances will ALP be liable for any indirect, consequential, special, or liquidated damages, including loss of project time, building access penalties, tenant disputes, or site delays.

10. Title & Risk

10.1. Risk in the goods passes to the Customer upon delivery to the specified site address or completion of installation.

10.2. Title to all goods remains with Australian Lift Protection until payment for the goods has been received in full.

11. Governing Law

11.1. These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of NSW.
